Wasch Raines LLP franchise attorney Adam G. Wasch was quoted in Restaurant Brands Online article Franchisees Navigate a Tough Environment by restaurant expert and RB Online Executive Editor Jonathan Maze.

In the article, Maze addresses the growing concern from franchisees that they are taking on all of the risks of owning and operating a business but with limited upside in larger franchise systems. The article serves as a current summary of the state of franchising in established franchise restaurant systems such as McDonald’s, Dunkin’ Brands, Jack in the Box, Wendy’s and Domino’s.

Maze concludes the article with 3 qualities of a good franchisor:

3 qualities of a good franchisor

What should franchisors do to have good relationships with their franchisees? We took this question to a pair of experts, franchisee attorneys Adam Wasch of Florida firm Wasch Raines and Chad Finkelstein of Canadian firm Dale & Lessmann. They gave us three best practices for maintaining a positive, productive relationship.

Fairness. Good franchise systems work to support struggling franchisees, even at good corporate expense, says Finkelstein. “They avoid litigation because they treat franchisees like actual partners and not royalty streams,” he says.

Consistency. Wasch said that management consistency is important in good franchise systems. “Turnover often causes a break in communications with franchisees,” he says, recommending that franchisors ensure there isn’t a revolving door in the corner office.

Transparency. Franchise systems have to be transparent with their owners. Good franchise systems will provide as much information to their franchisees as possible. Domino’s Pizza, for instance, is one of the only systems to publicly report operator cash flow.

Adam G. Wasch, managing partner of Wasch Raines, works with unit franchisees, multi-unit owners, and area developers in emerging and international franchise brands as franchise and litigation counsel. Mr. Wasch and the firm’s franchise group also represent more than three dozen startup, emerging and national/international franchise companies with an emphasis on startup franchising.

Wasch Raines’ franchise group has franchisee and franchisor clients from all over the United States and the world including countries like Australia, South Africa, Canada, and India.
